This privacy statement explains how Apex Loyalty, a company that offers a platform for loyalty incentives, gathers and manages the personal data you give us on ApexLoyalty.com. What does this privacy policy cover?

This privacy statement explains how we handle any personally identifiable data (“Personal Information”) that we learn about you when you visit or use our website or services.

We do not intentionally seek personal information from or collect personal information from anybody under 13 or enable such individuals to register for our services. Underage users cannot submit personal data to us or through the Services.

Whose information does Apex Loyalty collect?

On its website and loyalty applications, Apex Loyalty collects numerous kinds of Personal Information. Customers of a client who use their loyalty program’s services may provide Personal Information to Apex Loyalty. A client’s administrative users who oversee the loyalty program may also provide Personal Information.

An anonymised user token and no personal information may be used to identify End-Customers in the Apex Loyalty loyalty program.

What information does Apex Loyalty collect? 

We gather various types of Personal Information from our users, as explained more fully below. We may use Personal Information to personalise and improve the Services, to allow our users to set up a user account and profile, to contact users, to fulfil your requests for the Services, to analyse how users utilise the Website, and as otherwise outlined in this Privacy Policy. We collect the following types of information:

INFORMATION PROVIDED TO US

Information is provided to us by users using our website or our loyalty application. It may include name, email address, phone number, company name, postal address, social media handles, and other personal information.

INFORMATION COLLECTED AUTOMATICALLY

We automatically receive and log information from your browser whenever you use our website, including your IP address, “cookie” information, and the page you requested. “Cookies” are unique identifiers that we transmit to your computer or mobile device to let us recognise your browser or device and keep track of the frequency and timing of your visits to the various pages of our website. Will Apex Loyalty share any of the personal information it receives?

We employ other companies and people to perform tasks on our behalf and need to share your information with them to provide the Services to you. Please note that some information may remain in our private records after you delete such information from your account. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements but barring legal requirements; we will delete your statement within 90 days. We may use any aggregated data derived from or incorporating your Personal Information after you update or delete it, but not in a manner that would identify you personally.

TRANSFER OF YOUR DATA UNDER GDPR

Suppose Apex Loyalty receives your data from the data controller residing in the European Economic Area (“EEA”), United Kingdom, or Switzerland. In that case, it may process such data on its servers in the United States. These data transfers are covered by a Data Processing Addendum (“DPA”) that includes all Standard Contractual Clauses approved by the European Commission on June 4, 2021, to ensure GDPR compliance in case of Data being transferred from a Controller-Processor from the European Economic Area, United Kingdom or Switzerland to the United States.

Changes to this privacy policy

We may amend this Privacy Policy from time to time. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is used. Suppose we make material changes in how we use Personal Information. In that case, we will notify you by posting an announcement on our Website or emailing you before the change becomes effective. You are bound by any changes to the Privacy Policy when you use the Website after such changes have been first posted.
